These Terms and Conditions ("Terms") govern the use of the MAXPRO website and the appliance repair, diagnostic, maintenance, cleaning, and installation services provided by MAXPRO ("MAXPRO," "we," "us," or "our").

By using our website, submitting a service request, scheduling an appointment, approving an estimate or work authorization, or receiving services from MAXPRO, you acknowledge and agree to these Terms.

Nothing in these Terms is intended to limit any consumer right or remedy that cannot legally be waived under applicable federal, Florida, or local law.

1. Services

MAXPRO provides residential appliance diagnostic, repair, maintenance, cleaning, and installation services in the Tampa Bay Area, Florida.

Services may include work on major household appliances such as refrigerators, freezers, washers, dryers, dishwashers, ovens, ranges, stoves, cooktops, wine coolers, and ice makers, as well as certain range hood cleaning and dryer vent cleaning services.

Service availability depends on the appliance, its condition and accessibility, availability of replacement parts, technician availability, safety considerations, and the nature of the requested work.

MAXPRO may decline work that our technician determines cannot be performed safely or reasonably, requires specialized licensing outside the scope of our services, or is otherwise outside the services MAXPRO provides.

MAXPRO is an independent appliance service company. Unless expressly stated otherwise, MAXPRO is not affiliated with, authorized by, sponsored by, or endorsed by any appliance manufacturer or brand.

2. Service Requests and Appointments

Submitting a service request through our website, by telephone, by text message, or through another communication channel does not guarantee or confirm an appointment.

MAXPRO will confirm appointment availability separately.

Customers are responsible for providing accurate information when requesting service, including the service address, appliance type, known symptoms, and any relevant information regarding appliance accessibility or installation.

Appointment dates, times, and arrival windows are estimates rather than guaranteed arrival times. Delays may occur because of traffic, weather, previous appointments, parts availability, emergencies, or circumstances outside our reasonable control.

We will make reasonable efforts to notify customers of significant scheduling changes.

An adult age 18 or older must be present at the service location or otherwise provide appropriate authorization for access and the requested work.

3. Service Call and Diagnostic Fees

A service call and diagnostic fee applies to service visits.

The standard service call starts from $78.

Service calls involving certain built-in, combination, stacked, stackable, or otherwise difficult-to-access appliances start from $119.

The applicable service call fee covers the technician's visit and initial diagnostic evaluation and is due regardless of whether the customer proceeds with a repair.

The service call or diagnostic fee may still apply when:

  • The customer decides not to proceed with the recommended repair.
  • The appliance cannot reasonably or economically be repaired.
  • Required parts are unavailable or discontinued.
  • The technician determines that the requested work cannot safely or reasonably be performed.
  • The problem cannot be reproduced during the appointment.
  • No repair is performed following the diagnosis.

Certain appliances, conditions, or diagnostic procedures may require additional diagnostic work or charges. When reasonably practicable, the customer will be informed of additional charges before such work is performed.

4. Estimates and Authorization

After diagnosis, MAXPRO may provide an estimate for recommended work.

Estimates may include labor, parts, materials, applicable taxes, and other charges associated with the requested service.

A repair estimate is based on conditions reasonably observable or identifiable at the time of diagnosis. Appliance repair sometimes requires disassembly or further testing before all defects can be identified.

If additional problems or materially different conditions are discovered after work begins, MAXPRO will obtain additional customer authorization before performing material additional work.

By approving an estimate or work authorization verbally, electronically, in writing, or through our scheduling or invoicing system, the customer authorizes MAXPRO to perform the approved work and agrees to pay the applicable authorized charges.

Unless expressly stated otherwise, an estimate does not guarantee that additional unrelated defects will not be discovered or occur later.

5. Parts

Replacement parts may be original equipment manufacturer ("OEM"), manufacturer-authorized, aftermarket, refurbished, or other compatible parts, depending on availability, appliance age, cost, and the repair authorized by the customer.

MAXPRO may select an appropriate replacement part unless a particular type of part has been specifically agreed upon with the customer.

Part availability and estimated delivery times are not guaranteed.

MAXPRO is not responsible for delays caused by manufacturers, distributors, carriers, backorders, discontinued parts, shipping delays, or other circumstances outside our reasonable control.

Customers are responsible for providing accurate appliance information when requested. Incorrect model, serial number, or appliance information supplied by the customer may result in delays or additional costs.

6. Ordered Parts, Cancellations, and Restocking Fees

Once a customer authorizes MAXPRO to order a part, cancellation of the repair may result in a restocking fee.

The restocking fee starts from 25% of the applicable part price, with a minimum charge starting from $25, depending on supplier policies and costs associated with the order.

The customer may also be responsible for non-refundable shipping, supplier, special-order, or other costs actually incurred in connection with the authorized order when applicable and permitted by law.

Certain special-order, electrical, electronic, opened, installed, discontinued, or otherwise non-returnable parts may not be eligible for refund.

When reasonably practicable, MAXPRO will inform the customer before ordering a part known to be non-returnable or subject to unusual cancellation restrictions.

A restocking fee will not be charged when a return is required solely because MAXPRO ordered an incorrect part due to our own error.

Nothing in this section limits any cancellation or refund right that cannot legally be waived under applicable law.

7. Customer-Supplied Parts

MAXPRO may, at its discretion, agree to install a replacement part purchased or otherwise supplied by the customer.

Installation of a customer-supplied or previously purchased part starts from $250 unless a different price is quoted and approved before the work begins.

MAXPRO does not warrant a customer-supplied part and does not guarantee that it is correct, compatible, authentic, defect-free, or capable of resolving the reported appliance problem.

Unless expressly agreed otherwise in writing, MAXPRO's standard parts and labor warranty does not apply to work involving customer-supplied parts.

If a customer-supplied part is incorrect, defective, incompatible, or fails to resolve the appliance problem, the customer remains responsible for authorized service and labor charges.

MAXPRO may refuse to install any customer-supplied part that the technician reasonably believes is unsafe, damaged, incorrect, incompatible, counterfeit, unsuitable, or inappropriate for the appliance.

8. Appliance Installation

MAXPRO provides installation services for qualifying major household appliances when the installation can be safely and reasonably performed within the scope of our services.

Appliance installation starts from $225.

Installation involving qualifying gas appliances starts from $275.

Final pricing depends on the appliance, installation conditions, accessibility, required labor, required materials, and other circumstances identified before or during installation.

Additional charges may apply for non-standard conditions, additional labor, materials, difficult access, removal or repositioning of existing appliances, or work beyond a standard appliance installation.

Built-In, Combination, and Stackable Appliances

Certain built-in, combination, stacked, stackable, or unusually heavy appliances may require more than one person to safely lift, remove, position, or install.

Customers should disclose these conditions when requesting service.

When additional lifting assistance is necessary, the customer may be required to provide a physically capable adult to assist unless MAXPRO has agreed in advance to provide additional personnel, which may involve an additional charge.

MAXPRO may decline or reschedule work if adequate assistance is unavailable or if the technician determines that moving, lifting, removing, or installing the appliance would create an unreasonable safety or property-damage risk.

9. Gas, Electrical, Plumbing, Ventilation, Cabinetry, and Structural Conditions

Appliance service or installation does not include work that legally or safely requires a separately licensed electrician, plumber, gas contractor, HVAC contractor, general contractor, or other specialized professional unless MAXPRO expressly agrees to provide such work and is legally authorized to do so.

MAXPRO may refuse or postpone work if existing electrical, gas, plumbing, ventilation, cabinetry, flooring, connections, shutoff valves, outlets, wiring, or other conditions appear unsafe, damaged, inaccessible, unsuitable, or noncompliant.

Correction of such conditions is generally the customer's responsibility unless otherwise agreed in writing.

10. Access to Appliances

The customer is responsible for providing reasonable and safe access to the appliance and work area.

Customers should remove personal belongings, stored items, food, furniture, or other obstacles that could interfere with diagnosis, movement, disassembly, repair, or installation.

Built-in, stacked, tightly fitted, unusually heavy, or otherwise difficult-to-access appliances may require additional labor, equipment, or assistance.

If the technician determines that an appliance cannot be safely accessed or moved, MAXPRO may decline, modify, or postpone the work.

11. Pre-Existing and Hidden Conditions

Appliances, connections, cabinetry, flooring, plumbing, electrical components, hoses, valves, vents, and surrounding property may have pre-existing deterioration, damage, improper installation, corrosion, wear, or other defects.

Disassembly, movement, diagnosis, or repair may reveal conditions that were not reasonably visible beforehand.

To the extent permitted by law, MAXPRO is not responsible for damage or failure caused by pre-existing defects, deterioration, improper prior installation or repair, or hidden conditions that could not reasonably have been identified before service.

Examples may include deteriorated flooring, weakened cabinetry, brittle or corroded hoses and connections, damaged shutoff valves, deteriorated wiring, existing leaks, or improperly installed appliances.

If a material hidden condition is discovered, MAXPRO will notify the customer when reasonably practicable before performing additional work.

12. Cleaning Services

MAXPRO may provide certain appliance-related cleaning services, including range hood cleaning and dryer vent cleaning, when the technician determines the work can be safely and reasonably performed.

Cleaning services do not guarantee complete removal of all grease, lint, residue, stains, odors, buildup, or contamination.

MAXPRO may decline or discontinue cleaning work involving excessive contamination, hazardous substances, pest infestation, mold, inaccessible ductwork, rooftop access, structural disassembly, significant fire hazards, or other conditions outside the reasonable scope of residential appliance service.

13. Limited Repair Warranty

Unless otherwise stated in writing, qualifying repairs performed by MAXPRO include a 90-days limited warranty on MAXPRO-provided parts and labor.

The warranty period begins on the date the applicable repair is completed.

If, during the warranty period, the same appliance experiences a failure caused by the same diagnosed problem and the failure is attributable to a MAXPRO-provided part or MAXPRO's workmanship, MAXPRO will evaluate the appliance and, when the claim is covered, correct the covered repair without an additional charge for the warranted part or labor.

Warranty coverage applies only to the specific repair performed by MAXPRO.

The warranty does not cover:

  • Different or unrelated appliance problems
  • Failure of another appliance component
  • Normal wear and tear
  • Misuse, abuse, neglect, or improper maintenance
  • Power surges or electrical supply problems
  • Plumbing, drainage, or water supply problems
  • Gas supply problems
  • Improper installation or repair by another person
  • Pest or rodent damage
  • Water, fire, flood, storm, or environmental damage
  • Cosmetic conditions
  • Pre-existing or hidden conditions
  • Manufacturer defects unrelated to our repair
  • Damage resulting from continued use of an appliance after a malfunction or unsafe condition becomes apparent
  • Work altered, repaired, or modified by another person after MAXPRO's repair
  • Customer-supplied parts

Potential warranty issues must be reported to MAXPRO within the applicable warranty period.

MAXPRO must be given a reasonable opportunity to inspect and, when covered, correct the reported warranty issue.

14. No Guarantee of Future Appliance Performance

Repair of one appliance component does not guarantee the future operation of the entire appliance or prevent another component from failing.

Appliances contain numerous mechanical, electrical, electronic, plumbing, refrigeration, and other components that can fail independently.

MAXPRO's diagnosis and repair are limited to conditions reasonably identifiable during the service visit and the specific work authorized by the customer.

Except for the express limited warranty provided in these Terms and warranties that cannot legally be excluded, MAXPRO does not guarantee the remaining useful life, future performance, or overall condition of an appliance.

15. Customer Responsibilities

Customers agree to:

  • Provide accurate information regarding the appliance and reported problem.
  • Provide safe and reasonable access to the appliance and work area.
  • Ensure that an adult authorized to approve work is available when necessary.
  • Secure pets and keep children and other persons away from the technician's work area.
  • Inform MAXPRO about known leaks, electrical problems, gas issues, previous repairs, pest infestations, or other potentially unsafe conditions.
  • Provide functioning utilities reasonably necessary to diagnose and test the appliance.
  • Follow safety, maintenance, and operating instructions provided after service.
  • Stop using an appliance when continued operation appears unsafe or could reasonably cause additional damage.

16. Payment

Unless otherwise agreed in writing, payment is due when the applicable service is completed or at the time specified on the estimate, work authorization, or invoice.

Customers are responsible for charges they authorize.

Applicable taxes and legally permitted charges may be added when required.

If a customer believes a charge is incorrect, the customer should contact MAXPRO promptly and provide a reasonable opportunity for us to investigate and attempt to resolve the issue.

17. Cancellations and Rescheduling

Customers should notify MAXPRO as soon as reasonably possible when an appointment must be canceled or rescheduled.

Cancellation of an appointment or repair does not necessarily eliminate charges already incurred for completed diagnostic work, authorized services, ordered parts, special-order items, non-refundable supplier expenses, shipping, or other costs incurred with customer authorization.

Any applicable cancellation or restocking charges are subject to the terms disclosed to the customer and applicable law.

Nothing in these Terms limits any statutory cancellation right that applies to a particular transaction and cannot legally be waived.

18. Right to Refuse or Discontinue Service

MAXPRO reserves the right to refuse, discontinue, or reschedule service when reasonably necessary, including when:

  • The work environment is unsafe.
  • An appliance or installation presents an unreasonable safety hazard.
  • Required access is unavailable.
  • Required lifting assistance is unavailable.
  • The requested work requires licensing, equipment, or expertise outside our scope.
  • Conditions materially differ from those described when service was requested.
  • The presence of pests, contamination, hazardous materials, or other conditions creates a health or safety concern.
  • A customer or another person engages in threatening, abusive, discriminatory, harassing, or unsafe behavior.

Customers remain responsible for authorized services already performed and authorized costs already incurred, subject to applicable law.

19. Manufacturer and Third-Party Warranties

MAXPRO is an independent appliance service provider unless expressly stated otherwise.

Customers are responsible for determining whether an appliance is covered by a manufacturer warranty, retailer warranty, extended service plan, home warranty, or other third-party coverage before authorizing service.

Work performed by an independent service provider may affect certain third-party warranty rights.

MAXPRO is not responsible for a manufacturer, retailer, warranty provider, insurance company, or other third party approving or denying coverage.

20. Property and Safety

MAXPRO technicians will use reasonable care while working at a customer's property.

Customers should disclose delicate or damaged flooring, cabinetry, countertops, walls, furniture, connections, or other property requiring special precautions before work begins.

To the extent permitted by law, MAXPRO is not responsible for damage resulting from pre-existing deterioration, hidden defects, unsafe conditions, improper prior installation, or circumstances outside MAXPRO's reasonable control.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

21. Limitation of Liability

To the fullest extent permitted by applicable law, MAXPRO will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of our website or services.

Any limitation of liability contained in these Terms applies only to the extent permitted by applicable law and does not exclude or limit liability that cannot legally be excluded or limited.

22. Website Use

The MAXPRO website is provided for informational, scheduling, and customer-service purposes.

Submitting an online service request does not guarantee appointment availability or constitute confirmation of an appointment.

Prices or service descriptions displayed on the website are general information and may represent starting prices. Final pricing may depend on appliance type, condition, accessibility, required parts and labor, installation conditions, and other circumstances.

A final estimate or work authorization provided for a particular service controls over general website pricing for that service.

Users may not misuse the website, interfere with its operation, attempt unauthorized access to our systems, submit fraudulent requests, or use the website for unlawful purposes.

23. Intellectual Property

Unless otherwise stated, the MAXPRO name, logo, website design, text, graphics, photographs, and other original website content are owned by or licensed to MAXPRO.

Website content may not be copied, reproduced, distributed, modified, or commercially used without permission except as permitted by applicable law.

24. Privacy

Our collection and use of personal information are described in our Privacy Policy.

By submitting information through our website or otherwise providing information to MAXPRO, you acknowledge the practices described in the Privacy Policy.

25. Communications

By providing a telephone number or email address in connection with a service request, you authorize MAXPRO to contact you as reasonably necessary to respond to your inquiry and provide or administer the requested service.

Service-related communications may include appointment confirmations and reminders, technician updates, questions about your appliance, estimates, authorization requests, invoices, payment information, warranty communications, and customer-service follow-ups.

Consent to receive marketing communications is not a condition of purchasing MAXPRO services.

Any marketing email or text-message communications will be handled separately in accordance with applicable consent and opt-out requirements.

Where permitted by law and after providing any notice or obtaining any consent required by applicable law, telephone calls may be recorded or transcribed for customer service, documentation, training, quality assurance, safety, or dispute-resolution purposes.

26. Third-Party Services

MAXPRO may use third-party providers for website hosting, scheduling, communications, email delivery, payments, analytics, advertising, security, maps, reviews, and other business functions.

Use of those services may also be subject to the applicable provider's terms and privacy practices.

MAXPRO is not responsible for third-party websites or services outside our reasonable control except as otherwise required by applicable law.

27. Governing Law

These Terms and services provided by MAXPRO are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Nothing in these Terms prevents a consumer from exercising rights or remedies available under applicable consumer-protection law.

28. Disputes

If you have a concern regarding MAXPRO's services, please contact us and provide us with a reasonable opportunity to investigate and attempt to resolve the matter.

These Terms do not currently require mandatory arbitration.

Any dispute that cannot be resolved informally will be handled in accordance with applicable law and applicable jurisdiction and venue requirements.

29. Changes to These Terms

MAXPRO may update these Terms periodically to reflect changes to our services, business practices, pricing policies, technology, or legal requirements.

The current version will be posted on our website with an updated "Last Updated" date.

Changes will apply prospectively to the extent required by applicable law.

30. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

31. Service-Specific Agreements

These Terms should be read together with the customer's applicable estimate, work authorization, invoice, Privacy Policy, and any service-specific terms provided by MAXPRO.

If a service-specific estimate or work authorization conflicts with these general Terms, the service-specific written terms will control with respect to that service, except where prohibited by applicable law.
